County cracking down on panhandling

Commissioner Kathy Bryant raised the issue at Tuesday's commission meeting, sharing photos from a constituent that depicted trash allegedly left by a panhandler at State Road 200 and Southwest 60th Avenue.

"We need to do something about panhandlers," commission Chairman Stan McClain said during the meeting.

County Attorney Guy Minter told the commission that laws exist, but it was his "impression" that they weren't being enforced.

Undersheriff Dan Kuhn on Wednesday said, "We are using whatever lawful methods we can use to curb it."

Kuhn said the Sheriff's Office has gone as far as sending undercover deputies to infiltrate gaggles of homeless folks and asking the Florida Department of Transportation to issue trespassing warrants for panhandlers on state-owned rights of way — a request that FDOT officials rebuffed.

"It's not a lack of desire," Kuhn said.

Rather, the obstacle for law enforcement is the inability to catch panhandlers in an unlawful act, Kuhn added.

"If we have a lawful means of putting an end to it, we do," he said.

Finding such a means, though, has proven to be a struggle — although some county residents have offered ideas.

Stan Martin, a Summerfield resident, approached the County Commission in March, telling the commission that he had a petition with more than 300 signatures urging the commission to take action on panhandlers in that part of the county.

Martin said the community had had "great support" from the Sheriff's Office in dealing with beggars, but that was controlling them on private property.

He requested that the commission enact an ordinance similar to one from Alachua County that prevents panhandling in the streets.

But the commission's last attempt at that resulted in an expensive legal disaster.

In May 2006, the County Commission adopted an ordinance banning the solicitation of money at intersections in unincorporated Marion County without a license.

The local law, however, contained an exemption for charities — built-in protection for county firefighters who annually raise money on behalf of the Muscular Dystrophy Association.

To obtain a license, applicants must identify the times and locations of their begging, to provide a permanent address (which could be a homeless shelter), pass a background check and pay a fee of $ 100. If approved by the administrator of the county, the licensing authority designated, beggars, and then had to wear a badge identifying themselves as beggars.
