Magidson likely pick for federal prosecutor post

Assistant U.S. Attorney Kenneth Magidson is expected to be nominated as U.S. Attorney for the Houston-based Southern District of Texas as early as next week, sources said Thursday.

President Barack Obama is poised to nominate Magidson and other candidates to fill Texas' four U.S. attorney vacancies after two years of missteps and bickering among Lone Star State lawmakers, officials said.

Three Houston attorneys with close ties to Magidson said they expected him to receive the nomination soon.

When contacted Thursday, Magidson, who also served as interim Harris County district attorney in 2008, declined to comment.

Congressional Democrats want Obama to nominate Larry Veselka, a lawyer and former Harris County Democratic Party chairman.

The Texas nominations could come as early as next week, giving the Senate time to confirm the U.S. attorneys before an election year makes presidential appointments nearly impossible.

"I'm a little dumbfounded by their inactivity and their unwillingness to move forward," said Sen. John Cornyn, R-Texas, who recommended Magidson for the Houston job. "They haven't made this a priority."

Obama has nominated, and the Senate has confirmed, U.S. attorneys for every state but Texas, Utah and Mississippi.

Of the 93 U.S. attorney posts in the country, only 12 remained unfilled, including four in Texas, according to Main Justice, an organization that focuses on the Justice Department.

U.S. attorney positions are vacant in San Antonio, Houston, Dallas and Lufkin.

"It's frustrating. The president has announced for his second term, and we still don't have a U.S. marshal or U.S. attorney," said Rep. Gene Green, D-Houston.

White House spokesman Adam Abrams defended a deliberate system by the president to nominate "well-qualified candidates from diverse backgrounds who will respect the rule of law and understand how the law impacts Americans' daily lives.
